This Agence-becomweb.fr website (hereinafter, the “Site”), contains an online sales store offering dematerialized products (also referred to by the terms “modules”, “plugins” or extensions) and services Services. The purpose of this page is to describe and list the conditions governing this activity, as well as the use of the Site as a whole.

Definitions of the parties
The Customer: natural or legal person having full legal capacity when purchasing a Product or using the Services offered on the Site and / or natural person (s) user (s) of these same Products and Services under the responsibility of the customer. Prices and taxes
The prices indicated in Euro (€) are deemed to be net. They can be modified at any time without notice, knowing that the products will be invoiced on the basis in force when the order is recorded. The price is payable in full and in a single payment when ordering.
All orders are invoiced and payable in Euro only.
In accordance with article 293 B of the CGI, VAT is not applicable, the seller is not subject to its application by virtue of his statute.
Products
The merchant section of the Site offers dematerialized products for sale in the form of downloadable computer files developed by BeComWeb .
The dematerialized products purchased will be provided in the form of archives in zip format. The customer will be able to access the download of these files at the end of his order, after payment, on the order confirmation page or from the order confirmation e-mail he will have received. If the latter has created a customer account on the site, the products purchased can also be downloaded from the “My Account” area of this site.
For dematerialized products purchased via this Site, the Customer will benefit from free updates for a period of 2 (two) years from the date of the order. These updates will be accessible via a download link available in the “My Account” area and via an e-mail sent to the Customer when a new version of the product is made available.
The purchases of dematerialized products being, by nature firm and final, they cannot give rise to exchange, reimbursement or the exercise of a right of withdrawal.
No exceptions will be accepted, with the exception of those resulting from an error attributable to the Seller in the implementation of the distribution of the product (erroneous description, bad association of the downloadable file, etc.). Any other cause, in particular the Customer’s misinterpretation of the operation or scope of the product, will be null and void.
In the event that the customer’s complaint is admissible, it must be formulated within fourteen (14) days (in accordance with the legislation in force, through this site (through its contact form) and contain all the information necessary for its processing (order number, contact details, technical details such as the URL of the site using the product).
In the event of a refund, it will be made through a means chosen by the seller and within 30 days after acceptance of the complaint. At the customer’s convenience, a reduction voucher of an equivalent value to be used on an order placed on the Site may also be issued. Its period of validity cannot exceed 1 year.
As of the acceptance of the reimbursement, the downloading of the dematerialized product(s) concerned will be revoked. the customer also agrees to uninstall and no longer use this product or cases. In the event that the Customer continues to use the product, in any form whatsoever, the Seller may take legal action against the Customer.
All products offered for sale, including free, are and remain the exclusive property of the Seller. No transfer of intellectual property rights is carried out through these GTC. Consequently, any reproduction (total or partial), redistribution, modification, or use (for commercial purposes or not) for any reason whatsoever is strictly prohibited.
Liability and litigation
The seller is responsible for the proper execution of these general conditions. However, this liability cannot be incurred due to a fortuitous event, a case of force majeure, the unforeseeable and insurmountable fact of a third party to the contract or due to the non-compliance of the product with foreign legislation in the event of delivery in a country other than France.
The seller cannot be held responsible in the event of loss of data, technical failure or interruption of service of the customer’s facilities caused by the use of a product purchased on the Site or the intervention of the Seller as part of a service. concluded on this one.
The use of the products supplied by BeComWeb is planned within the framework of normal use (stable execution environment, compliance with the good practices in force, etc.). As part of the performance of a service, if specific conditions (administrative, legal or technical) must be respected, the customer undertakes to communicate them before the conclusion of the transaction.
Cases of force majeure due to external factors such as weather conditions, the failure of an electrical or telecommunications network or having their origin in a cause outside the professional context binding the Customer and the Seller suspend the Seller’s obligations. and relieve him of his responsibility. This list cannot be considered exhaustive.
The seller also disclaims any responsibility for the content of sites to which hypertext links could refer from his own site.
All the clauses appearing in these General Conditions of Sale, as well as all the purchase and sale operations referred to therein, are subject to French law. In the event of a dispute and, in the absence of an amicable agreement, the competent court will be the Commercial Court of La Rochelle.
The Seller respects his obligation of advice by making available several informative means by means of the item sheets of the products (descriptions, image galleries, etc.). It also provides pre-sales support that can be requested by electronic mail or telephone call.
